Terms of Service

These Terms of Service ("Terms") govern your use of Convoct ("Service"), operated by Convoct ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. Description of Service
Convoct is a WhatsApp attribution and conversion tracking platform that helps businesses attribute WhatsApp leads to digital advertising campaigns and upload conversion signals to Google Ads and Meta Ads.
2. Eligibility
You must be at least 18 years old and represent a legally registered business to use Convoct. By using the Service, you confirm that you have the authority to bind your business to these Terms.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service to collect data from individuals without their knowledge or lawful basis.
- Upload conversion data that does not comply with the policies of Google Ads or Meta Ads.
- Attempt to reverse-engineer, disassemble, or exploit any part of the Service.
- Use the Service for any unlawful purpose or in violation of any applicable regulations including GDPR, CCPA, or WhatsApp's Business Policy.
5. Data and Privacy
You retain ownership of your business data. By using the Service, you grant Convoct permission to process that data solely to provide the Service. You are responsible for ensuring you have a lawful basis to collect and process end-user data through the Convoct tracking snippet installed on your website.

6. Third-Party Integrations
The Service integrates with Google Ads and Meta Ads. Your use of those integrations is also subject to Google's and Meta's respective terms of service. Convoct is not responsible for changes to third-party APIs or policies that affect the Service.
7. Intellectual Property
All content, code, and branding of the Convoct platform are owned by Convoct. You are granted a limited, non-exclusive license to use the Service for your internal business purposes.
8. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance or make changes to the Service at any time with reasonable notice where practicable.
9. Limitation of Liability
To the maximum extent permitted by law, Convoct shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of attribution data, ad spend, or revenue.
10. Termination
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data will be deleted within 30 days per our data retention policy.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes will be communicated via email or in-app notice.
12. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
